Event Agreement

This Release of Liability and Event Agreement (“Agreement”) is entered into between Catherine Morgan Limited (“Company”) and you, the Event Attendee deciding to attend the Event as outlined below (“Participant”). Participant understands and agrees they are entering into a legally binding Agreement with Company, inclusive of the following terms and conditions as outlined herein, and the Privacy Policy found on https://catherinemorgan.com/terms-and-conditions

General Event Itinerary

Participant is electing to attend the Company’s Event, a two (2) day, live event located in Jersey, Channel Islands, designed to educate Participants about money mindset. 

Consideration for Event

A non-refundable deposit of £1,000 is payable for the Event. The remaining balance as shown on your invoice is payable at least 1 month prior to the retreat start date in order to attend. This is to be paid in full. The Participant understands that if they opt for the deposit option, they are liable for the full amount.

Cancellation Policy

More than 90 days before the retreat: Guests can cancel without any further payments. The £1,000 deposit will not be refunded. If the retreat has been paid in full, any amount over £1,000 will be refunded.  

Within 90 days of the retreat: Guests are liable for the full remaining balance unless transferred to a new guest as under the Transfer Policy. 

Transfer Policy

If you are unable to attend, you may transfer your booking to another person with prior notification to us at least 7 days before the retreat starts. The new guest will be responsible for any remaining payment due and being agreeable to these terms and conditions. We will not be responsible for finding a replacement.

Late Payments

Final payments must be made on or before the due date, 30 days before the retreat. Late payments may incur an additional fee of £150, and failure to make payments on time may result in cancellation of your booking without refund and remaining balances still to be paid.

Force Majeure

In the event of circumstances beyond our control (e.g., natural disasters, pandemics), we reserve the right to cancel the retreat. In such cases, guests will receive the option to transfer their booking to a future retreat. No refunds will be offered. 

Voluntary Participation

Participant agrees and understands that their decision to attend and participate in the Event is purely voluntary, and must be independently decided by the Participant. To the extent allowable by law, any negative felt experiences before, during, or after the Event is no fault or responsibility of the Company. Participant acknowledges the Company has not forced the Participant to be at the Event; the Participant has decided based upon the totality of circumstances that it would benefit them to attend, and that the Participant would like to attend, inclusive of all potential activities and trainings offered at the Event, and does not hold the Company responsible for such a decision. The Participant will not hold the Company nor any affiliates, employees, owners, or contractors responsible for any injury, issue, or negative experience occurring while at the Event, as a result of their attendance, or any portion of travel to and from the Event or any excursions organised during the Event.

Travel

Participant acknowledges they will need to travel in order to attend the Event, and confirms that the decision to travel, and the manner and mode by which they choose to travel in order to get to the Event is wholly of the Participant’s own choosing, and not in any way associated with the Event or Company, nor is it included in the Event. Should the Participant encounter a negative situation or result from the choice of manner of travel, including but not limited to lost luggage, flight delay, injury, illness, or other property loss, the Participant understands and agrees that the Company is neither responsible nor liable in any way, and that any required or optional travel is in no way associated with the Event.

Accommodation

The retreat includes accommodation for three nights at L’Horizon Hotel, St Brelades Bay, Jersey (Monday, Tuesday, and Wednesday) based on the room type selected at checkout. Shared rooms are available, each shared with one other person and featuring twin beds. While we do our best to accommodate pairing requests, we cannot guarantee specific pairings. Breakfast is included for all three mornings of the retreat.

Room Upgrades

Participants may request to upgrade their rooms. While we will try to accommodate these requests, upgrades are not guaranteed and are subject to availability on a first come first served basis.

Food

The Company will provide lunches, dessert, teas and coffees, and water across the two-day retreat, as well as dinner on the final night (Wednesday). This includes 2 glasses of wine. All other meals, snacks, and food will be up to the Participant, and at the Participant’s sole expense.

For all meals provided by the Company, the Participant understands the Company will do its best to label any and all food and drink options in order to identify any potential allergens contained in a meal or food item but cannot guarantee the accuracy or completeness of all food warnings. If the Company is hosting at a restaurant, the Participant may inquire within the restaurant regarding any allergies or dietary restrictions. The Participant will use their own independent judgement to determine if such food and/or drinks are appropriate for their consumption and will use common sense in making decisions regarding what to consume while at the Event. The Company is not to be held responsible should the Participant have any adverse reaction to foods or drinks while at the Event, whether due to a known or unknown cause, whether food was appropriately labelled or not. The Participant takes full responsibility for choosing what to eat at the Event, if anything, and agrees the Company nor any Company employee, owner, affiliate, or contractor is not responsible should the Participant experience any sort of health-related issue while at the Event.

Risk Acknowledgement and Acceptance

The Participant understands and acknowledges there may also be a risk from contact with other participants, including negligent or wanton acts of other participants, failures in following guidelines and rules of the event or any applicable laws (whether health-related or not), any defects of conditions of the premises where the Event is held, and/or any effects of weather, including heat, cold, rain, winds, storms, or humidity. The Participant further acknowledges that each of these risks are those which the Participant voluntarily assumes and agrees the Company is in no way responsible or liable for any negative results or injuries they may sustain as a result of the above risks they may encounter. The Participant has the option to leave the Event at any time, should it become unsuitable for the Participant. The Participant understands the Company is not responsible for any resulting injury, damages, illness, failure of others to follow guidelines, property loss, or other negative issue that occurs during or after the Event.

Medical Attention

Should it be determined at any time during the Event that the Participant needs medical attention, the Participant consents to receiving emergency medical care and transportation as deemed appropriate and necessary by medical professionals called to the Event, or on site with the venue. This Release also extends to any liability arising out of or related to any medical treatment provided to Participant, including but not limited to negligent emergency rescue options. Participant confirms that should they sustain any injury requiring medical attention, the Company is not liable, nor responsible in any way, financial or otherwise. Participant agrees to hold Company harmless from any injury or illness sustained, directly or indirectly caused by participation in the Event, and confirms they will not involve the Company in any claim, lawsuit, or cause of action related to injuries sustained or damages alleged directly or indirectly from Participant’s attendance at or involvement in the Event.

Disclaimer / Indemnification

Participant expressly agrees to indemnify and hold the Company and all affiliates, contractors, employees, and owners harmless against any and all claims, demands, damages, rights or causes of action or any person or entity that may arise from injuries or damages sustained by Participant while attending the Event, and agree to hold the Company harmless should any physical, emotional, or financial injury occur as a direct or indirect result of any aspect of the Event. Participants confirm they are attending voluntarily and confirm any expectations or preconceived notions about the Event are purely speculation.

Company is also not to be responsible nor liable if the Event is not what Participant expects, or if Participant is subjectively dissatisfied with the Event. Company does its best to accurately and adequately market the Event to outline the content, potential benefits, and past attendees’ experiences; however, none of the above guarantees participants will have the same experiences, same results, or obtain any tangible or financial benefits from the Event. Company cannot guarantee the Participant will experience any financial or personal gain from the Event, and promises only to deliver the training and Event as promised.

Participant understands that all services provided by Company in connection with the Event are provided on an “as is” basis, meaning it is without any guarantees, representations, or warranties, including but not limited to warranties relating to quality, non-infringement, fitness for a particular purpose, merchantability, or expectation or course of performance. Participant is choosing to attend the Event on a purely voluntary basis and does not hold the Company responsible should the Participant become dissatisfied with any portion of the Event. Participants agree that they do not have a cause of action, legal remedy, and are not entitled to a refund should they not achieve the results desired following the Event.

COVID Release

By participating in the Event, participants understand they may be exposed to COVID-19, and may contract this or another virus as a direct or indirect result. Participant confirms they have independently weighed the risks, conducted any additional research, asked any necessary questions, and made a voluntary decision to attend the Event and hereby assume all such risks associated with potential COVID-19 transmission or exposure, and accept sole responsibility for any illness, injury, damage, claim, or exposure arising from the Event.

Participant agrees Company is not liable or responsible in any way, financially or otherwise, should Participant be exposed to or contract COVID-19 or any other virus as a direct or indirect result of attending the Event. Participant agrees to hold the Company and any other assistants participating in the Event harmless from any medical expenses, emotional damage or other alleged or real costs, damages, causes of action, or claims that may result from contracting COVID-19 or any other illness. As consideration for this waiver, Company agrees to waive any liability or claim against Participant for COVID-19 transmission or exposure. However, all such waivers shall not prohibit actions or claims against any person who knowingly participated in the Event while exhibiting COVID-19 symptoms, or who knowingly participated while having an active COVID-19 infection.

Dispute Resolution

Any dispute or issue relating to the Event is to be resolved via mediation in or as near as possible to the country of Jersey. This Waiver is also controlled by Jersey Law and is to be construed by the laws of Jersey, regardless of the location of the Event or Participant.

Photo/Media Release

The Participant understands and agrees that the Event may be filmed, recorded, and/or documented in some way by photographers, media, or other members of the press, or by other participants at the Event. Participants understand they may be videotaped, photographed, or otherwise captured at the Event, and consents to their likeness being used in such media. Participant hereby grants Company a royalty-free, irrevocable licence to use Participant’s name, likeness, and image in using such video and photography from the Event for commercial use, as it sees fit. This may include but is not limited to posting photos and video on Company’s website, and social media channels (Facebook, Instagram, Twitter, etc.), future sales pages and advertisements for future Events, and to promote and publicise the Event in general. The Company may also sell or assign the right to use such images or other materials to third parties. By purchasing a spot in the Event and agreeing to this Waiver, Participant provides Company with a full, irrevocable release allowing Company and any other relevant party to use their name and likeness, and all such footage in any way it sees fit.

Other Event attendees and presenters may also have recording devices, including cell phones, laptops, and other means of recording footage, photos, and audio that they may share online via social media applications. Participant understands that attendees are within their rights to do so, and that Participant does not have any expectation of privacy at the Event – they understand and agree they will likely be photographed or filmed, whether in the background or forefront of such recordings, and such images or videos may be shared by the person who records them. Company is not responsible for footage, photographs, and any other information obtained by Event attendees and posted on social media, the Internet, and/or other avenues. Participant agrees to fully indemnify and hold harmless Company and any affiliates of the Event should any attendee post or broadcast any form of photography or media regarding or including Participant, whether intentional or unintentional. Company is not responsible nor liable for what attendees may post, and Participant agrees they are attending the Event voluntarily, and assumes any and all such risks of being photographed or otherwise recorded by Event staff, attendees, guest experts, speakers, and/or Company.

Agreement to Terms

By checking the corresponding box next to this agreement on the purchase page and completing the purchase, I acknowledge that I have read and understood the waiver and release. I voluntarily agree to the terms as written, with full knowledge of its content and meaning. I understand that this waiver is in addition to and in accordance with any other agreements between myself and the Company related to other programs or services I am participating in.
